Hickory FC Ticket Terms and Conditions
IMPORTANT NOTICE:
THIS TICKET IS A REVOCABLE LICENSE. BY PURCHASING, ACCEPTING, HOLDING, OR USING THIS TICKET FOR ENTRY INTO MORETZ STADIUM IN HICKORY, NORTH CAROLINA (THE “STADIUM”), YOU AGREE TO THESE TICKET TERMS & CONDITIONS (“TERMS”). THESE TERMS AFFECT YOUR LEGAL RIGHTS.
1. Ticket Is a Revocable License
This ticket grants the bearer (“Holder”) a limited, revocable license to enter the Stadium and attend the Hickory FC match or event identified on the ticket (the “Event”). The ticket does not confer any property or ownership rights.
Admission is contingent upon Holder’s compliance with these Terms, the United Soccer League (“USL”) Fan Code of Conduct, Stadium, LRU, and Hickory FC policies, and all applicable laws. Failure to comply may result in revocation of this license without refund.
2. Club and USL Authority
For purposes of these Terms:
- “Club” and “Hickory FC” mean 828FC, LLC d/b/a Hickory FC and its owners, managers, employees, contractors, agents, volunteers, and vendors.
- “LRU” means Lenoir-Rhyne University and its trustees, directors, officers, employees, contractors, and agents.
- “USL Family” includes United Soccer Leagues, LLC and its affiliated entities, including Premier Development League, LLC, which operates USL League Two, and their directors, officers, employees, contractors, and agents.
Admission may be refused or withdrawn, and Holder may be ejected, in the sole discretion of the Club, the Stadium operator, or the USL Family.
3. Event Date, Time, and Cancellation
Event dates and times are subject to change. A change in date or time does not entitle Holder to a refund.
If an Event is cancelled and not rescheduled within twelve (12) months, the Club may, at its option:
- issue a ticket to a rescheduled or comparable Event, or
- provide a refund up to the face value of the ticket.
This is Holder’s sole and exclusive remedy. The Club and USL Family are not responsible for incidental or consequential expenses (including travel or lodging).
4. Admission, Security, and Searches
All persons and belongings entering the Stadium are subject to reasonable security screening. Refusal to consent to screening may result in denial of entry or ejection without refund.
Prohibited items may be restricted or confiscated in the interest of safety or operations.
5. Fan Conduct
Holder agrees to comply with the USL Fan Code of Conduct, available at https://www.uslsoccer.com/fan-code-of-conduct
Prohibited conduct includes, without limitation:
· abusive, threatening, discriminatory, or violent behavior;
· entering the field of play;
· throwing objects;
· interfering with the match or other spectators;
· illegal activity; or
· failure to follow Stadium or Club staff instructions.
Violations may result in ejection, venue bans, loss of ticket privileges, or arrest, with no refund issued.
6. Resale and Invalid Tickets
Resale or attempted resale of this ticket in violation of applicable law is prohibited and may result in cancellation without refund.
The Club is not responsible for lost, stolen, duplicated, or counterfeit tickets.
7. Minors
Children under twenty‑four (24) months of age are admitted without a ticket provided they remain seated on the lap of an accompanying adult.
All other attendees must possess a valid ticket. Adults accompanying minors represent they have authority to accept these Terms on the minor’s behalf and are responsible for the minor’s conduct.
8. Photography, Video, and Event Content
Personal, non‑commercial use permitted. Holders may take photographs or video for personal use and share them socially, provided such activity does not disrupt the Event or Stadium operations.
Commercial use prohibited. Commercial recording, monetized livestreaming, play‑by‑play transmission, advertising, or promotional use of Event content without prior written consent of the Club or USL is prohibited.
Professional or broadcast‑grade equipment may be restricted.
9. Image and Likeness Release
Holder grants the Club, the USL Family, and their designees a worldwide, royalty‑free right to use Holder’s image, likeness, name, voice, and actions captured in connection with the Event for broadcast, news, promotional, and related purposes, in any medium, without compensation, except where prohibited by law.
10. Assumption of Risk and Release
Attendance is voluntary. Holder assumes all risks inherent in attending a sporting event and public gathering, including risk of personal injury, illness, property damage, or exposure to communicable diseases.
To the fullest extent permitted by North Carolina law, Holder releases the Club, the Stadium operator, LRU, the USL Family, and their affiliates from claims arising from attendance at the Event.
IN NO EVENT WILL HICKORY FC, LRU, OR THE USL FAMILY BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES OR FOR LOST PROFITS, REVENUES, OR BUSINESS OPPORTUNITIES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Health and Safety Compliance
Holder agrees to comply with all reasonable health and safety policies communicated by the Club or Stadium staff, including bag policies, entry protocols, emergency procedures, and posted signage.
12. Dispute Resolution
Informal Resolution. Prior to filing a claim, Holder agrees to provide written notice to the Club and allow thirty (30) days for good‑faith resolution.
Arbitration. Any dispute arising out of or related to this ticket, these Terms, or attendance at the Event shall be resolved by final and binding individual arbitration.
13. Governing Law and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict‑of‑law principles. Subject to the arbitration clause, any permitted court action shall be brought in a state court located in Catawba County, North Carolina or a federal court located in the Western District of North Carolina.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Changes to Terms
The Club reserves the right to modify these Terms at any time. The Terms in effect at the time of ticket purchase or first use govern the Event.
